These Terms of Service ("Terms") govern your access to and use of the aiStudio57 website and services, including our AI Receptionist and AI Video Production services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use our Services. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting on this page.

Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the business you represent. By using our Services, you represent and warrant that you meet these requirements.

Account Registration

To use certain Services, you may be required to create an account. You agree to:

• Maintain and promptly update your account information
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

AI Receptionist Service Terms

Service Description

Our AI Receptionist service ($99/month) includes:

• 24/7 inbound call answering with natural AI voice
• Basic call handling and message taking
• Appointment scheduling to one calendar
• Call summaries via email or text

Service Limitations

The $99/month plan includes:

• One business location
• One phone number
• One calendar integration
• Inbound calls only (no outbound calling)

Call Recording and Consent

By using our AI Receptionist service, you acknowledge and agree that:

• All inbound calls will be recorded for quality assurance and service provision
• You are responsible for ensuring compliance with applicable call recording laws in your jurisdiction
• You will inform callers that calls may be recorded if required by local law
• Call recordings are retained for 30 days unless you request longer retention

Setup and Deployment

Setup typically takes 7-14 business days. We will work with you to configure the AI agent for your business needs. You are responsible for providing accurate business information, FAQs, and appointment booking preferences.

Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted service. We are not liable for service interruptions due to maintenance, technical issues, or circumstances beyond our control.

AI Video Production Service Terms

Service Offerings

We offer two tiers of AI video production:

• AI Promo Clip ($199): 30-second video with template script, AI voiceover, and simple visuals
• Professional AI Video ($499): 60-second custom video with full branding and one revision

Delivery Timeline

Videos are typically delivered within 5-7 business days after we receive all required information from you (business details, branding assets, content preferences).

Revisions

• AI Promo Clip ($199): No revisions included
• Professional AI Video ($499): One revision pass included
• Additional revisions: $99 per revision round

Usage Rights

Upon full payment, you receive full commercial usage rights to use the video for your business marketing purposes. You may not resell, redistribute, or claim authorship of the video content.

Payment Terms

Pricing and Billing

• AI Receptionist: $99/month, billed monthly
• AI Video services: One-time payment, paid upfront before production begins
• Consulting services: Billed hourly ($200/hr phone, $400/hr in-person)
• All prices are in USD
• Prices are subject to change with 30 days notice

Payment Methods

We accept various payment methods including check, wire transfer, and credit card. By providing payment information, you authorize us to charge your payment method for all fees incurred.

Late Payments

If payment fails, we will attempt to process payment again. If payment cannot be processed after 7 days, your service may be suspended until payment is received.

Refund Policy

• AI Receptionist: No refunds for partial months. Cancel anytime to stop future billing.
• AI Video Services: 50% refund if you cancel before production begins. No refunds once production starts.

Cancellation and Termination

Your Right to Cancel

You may cancel your AI Receptionist subscription at any time by contacting us at info@aistudio57.com. Cancellation will take effect at the end of your current billing period.

Our Right to Terminate

We may suspend or terminate your access to the Services if:

• You breach these Terms
• Your payment fails
• You engage in fraudulent or illegal activity
• Your use of the Services harms our systems or other users

Data Ownership and Usage

Your Data: You retain all ownership rights to your business data, caller information, and content you provide. We process this data solely to deliver the Services.

Our IP: We retain all ownership rights to our AI models, software, technology, and platform. These Terms do not grant you any intellectual property rights in our Services.

Acceptable Use Policy

You agree not to:

• Use the Services for any illegal or unauthorized purpose
• Violate any laws, including call recording and privacy laws
• Impersonate another person or entity
• Interfere with or disrupt the Services
• Attempt to gain unauthorized access to our systems
• Use the Services to harass, abuse, or harm others
• Reverse engineer or attempt to extract our source code
• Use automated systems to access the Services without permission

Warranties and Disclaimers

Service Provided "As Is": The Services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Services, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

AI Limitations: AI technology has limitations. While our AI Receptionist strives for accuracy, it may occasionally make errors, misunderstand callers, or provide incorrect information. You are responsible for monitoring the AI's performance and reporting issues promptly.

Limitation of Liability

To the maximum extent permitted by law, aiStudio57 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Lost profits or business opportunities
• Loss of data or goodwill
• Service interruptions
• Missed calls or appointments
• AI errors or inaccuracies

Our total liability for any claims arising from these Terms or the Services shall not exceed the amount you paid to us in the 12 months preceding the claim, or $500, whichever is less.

Indemnification

You agree to indemnify, defend, and hold harmless aiStudio57, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any laws or regulations
• Your violation of any third-party rights

Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State in which aiStudio57 operates, without regard to conflict of law principles.

Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through our website. Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.
